Terms and Conditions for Commissioned Portraits & Artwork By Eugenia Smirnova
Overview
These Terms and Conditions apply to all commissioned artwork created by Eugenia Smirnova (referred to as “the Artist”). By purchasing a commission through this website or directly from the Artist, you (the “Client”) agree to the following terms.
1. Acceptance
Commissioning artwork or making a purchase implies full acceptance of these Terms. No signature is required.
2. Payment
Clients may pay in full or through installments. An initial payment secures your place in the Artist’s schedule. The final artwork will not be delivered or shipped until the total balance is paid in full.
3. Accepted Payment Method
• Apple Pay
• PayPal
• Checks, cash, or Venmo (available upon request)
4. Refund Policy
• A full refund is available within 7 days of initial payment.
• For installment plans, the 7-day refund window applies only to the first payment.
• Refund requests must be submitted via email within that period.
• After 7 days, refunds are only issued if:
• The Artist cancels the commission, or the artwork is damaged in shipping (subject to carrier policy).
5. Returns & Exchanges
Due to the custom nature of the work, returns and exchanges are not accepted.
6. Commission Denial
The Artist reserves the right to decline any commission. If payment is made, a full refund will be issued
7. Termination
Either party may terminate the commission at any time.
If the Client cancels:
• A refund is only granted if requested within 7 days of initial payment.
• No further payments are required.
• The Artist may complete the artwork for resale or other purposes.
If the Artist cancels:
• A full refund will be issued, regardless of project status.
8. Adjustments
• Minor adjustments are included at no charge.
• Major adjustments (deviations from the original reference or instructions) may incur additional fees.
• Special requests should be communicated at the time of purchase.
9. Pricing
• Prices are subject to change without notice.
• If you are on an installment plan, your price will remain locked in.
• If a sale occurs after your initial payment, the discount will be applied to the remaining installments.
10. Timeline
• An estimated completion date is provided at purchase.
• This is an estimate, not a guarantee.
• The Artist will inform the Client of any significant delays.
11. Shipping. The Client covers all shipping costs.
• Artworks up to 20”x24” are shipped via USPS Priority Mail.
• Sizes 24”x30” and larger are shipped via FedEx Ground.
• Shipping is free within the U.S.
• Alternate carriers may be used at the Client’s request and expense.
• International shipping is available upon request;
12. Postal Damage & Loss
• All artwork is carefully packaged and insured.
• If damage occurs:
• Take clear photos of the packaging and artwork immediately.
• Return the item in its original condition (Client covers return shipping).
• The Artist will file an insurance claim and issue a refund if the claim is approved.
As of March 24, 2025, no shipping damage has been reported.
13. Copyright & Usage
• The Artist retains all rights to the commissioned artwork.
• The Client may display the artwork for personal use.
• If shared on social media, the Artist must be credited.
• Reproduction is prohibited without written permission.
14. Digital Image Disclaimer
Please note that digital images may not reflect the true color and texture of the final piece due to screen and device variations. The Artist works to ensure the most accurate digital representation possible.
15. Policy Updates
These Terms and Conditions are subject to change at any time.
